A Lasting Power of Attorney appoints people you trust to be able to do things for you when you are alive. This could be if you are:-
- abroad for a length of time (they can handle your affairs while you are away) or
- if you are infirm and unable to travel into town or to the Bank etc, or
- if you are bedridden or
- If you are suffering from a degenerative illness.
We would actually recommend everyone over 40 years of age to consider making Lasting Power of Attorneys. They differ from a Will because they take effect while you are still alive whereas a Will takes effect after you have passed on.
If you have been diagnosed in the early stages of a degenerative illness, or your mobility is reducing year by year or if you are suffering a terminal illness, you can help your loved ones care for you by appointing Attorneys to act on your behalf. Your Attorneys can indeed often be your loved ones.
There are two types of Lasting Power of Attorney. The first is a Health and Welfare Power of Attorney and the second is a Property and Financial Affairs Power of Attorney. You can choose to have either or both. If both are ordered at the same time there is a reduction in the price.
Both types of Lasting Powers of Attorney must be registered with the Court of Protection to take effect, but we can take care of all this for you.
